In business, there’s always the possibility of being involved in litigation. Your lawyer will no doubt offer timely advice, but here’s a tip that can save you a lot of dollars and possibly save your business, too.
Make the effort to sit around the table before you get to court, and try to resolve matters on a common sense basis. Do some horse trading. The last thing you want or need is to be spending an enormous amount of money on court costs – this may sound the death knell for your business. Think constantly how you can resolve the matter, not only before you get to court but while you’re there.

During my years in Commercial and Industrial Real Estate I learnt the vital importance of taking File notes during negotiation of lease agreements and in particular when something went or looked as though it was about to go wrong, During my time with the firm i worked with I never had to front court although a couple of years after i resigned I was asked if I could front up at The Magistrates Court in Melbourne regarding a lease I had negotiated, Fortunately at the 11th hour just before the magistrate was due to hear the case the parties involved reached an agreement which was great, The Client concerned was very pleased with the outcome and I was asked by the firm concerned on two occasions to return to them on assignment, I still have some contact with them and we are on very good terms.
